Federal Court Blocks New York From Eliminating Religious Exemptions to Health Care Worker Vaccine Mandate

Health care workers in New York successfully obtained a temporary restraining order prohibiting the New York State Department of Health (DOH) from “enforcing any requirement that employers deny religious exemptions from COVID-19 vaccination.” Further, “[t]he DOH is barred from interfering in any way with the granting of religious exemptions from COVID-19 vaccination going forward.”

Plaintiffs in the matter argue that the DOH’s blanket prohibition on religious exemptions to New York’s health care worker vaccine mandate violates federal employment law, the First Amendment, and the Equal Protection Clause.
